pam cook. steve, you say cooler this morning but then warming up a bit? >> exactly. we have mostly clear skies and temperatures for this time of year low to mid 40s. i just heard from kirk up in mendocino county he has 30 degrees. highs 60s and 70s. a lot of upper 70s in areas that have been in the low 70s lately. and a few low 80s. here is sal. good morning. traffic is moving off pretty well. we are off to a nice start. i hope it stays that way. moving along taking a look at san francisco same thing goes. it's 6:01 let's go back to dave and tori. at 6:01 election news for you. it's a close contest for prop 29 that is the cigarette proposal here in california. right now it's losing by a whisker. look at the numbers on the screen. 49.2% yes, 50.8% no.

ktvu lorraine blanco is joining us live now. she is in san leandro with a lot more on this race that is still too close to call. >> reporter: dave, with 100% of precincts reporting this morning, the no's on prop 29 are ahead. we talked to many that said thank goodness but they said if the tax did go, they would still buy them. it aims to tax cigarettes by $1. it would have raised $700 million for cancer research. >> i'm impressed. i mean i think everything is tax too much. i know it's benefiting. not the working class. so what good is it?

>> the no on 29 campaign bankroll by the tobacco industry. far out the anti29 campaign for the initiative would send research dollars out of state because it did not dictate where the money must be spent. supporters spent close to 18 million. they anticipate it would 6:03. it appears california voters are given way a. 38.6% sea. however they will still be allowed to spend those years in the same house. in san jose pension reform has passed. voters said yes to measure b and it won by a big margin.

this is seen as a win for san jose mayor chuck reid and a loss for city employee unions. the union says the mayor should not celebrate too much because they will take the issue to court today. >> it's going to save the city of san jose billions of dollars. that is really important. so we can begin to restore services. >> measure b lets current employees keep pension credits but they have to pay up to 16% more to keep it going. the measure would require future hires to pay 50% of the cost of a pension. opponents charged the city with walking away from its contract. city worker unions are causing swift legal actions. we will talk live with mayor

sofas that can take anything life throws at them. 6:14. now to the election results of two congressional districts here in the bay area. district two runs from marin county up to the oregon state border. and in the battle to replace retiring congresswoman lynn, huffman received 37% of the vote. he will face off against daniel roberts that received 15%. due to the states new open primary system, two dr.s will compete -- two democrats will compete for the east bay newly drawn 18th district.

steve stark received 97% of the vote. time now 6:14. only one of the two san francisco measures passed with 100% of the precincts reporting now. almost 77% of voters rejected measure a. that would have required competitive bidding for burgage collect -- garbage collecting. and dividing into different types of trash and locations. measure b is a nonminding. it barely passed. money raised from coit tower will be used to replace the murals inside. the stakes got higher for president obama in wisconsin. they failed to recall the states republican governor. alison burns is in our washington, d.c. newsroom. alison. >> reporter: democrats and republicans nation-wide were

closely watching the recall vote in wisconsin. it was a big test. not only for republican governor scott walker aggressive style but also for a state law limiting collective bargaining from the public employees and teachers. walker kept his job and beat his challenger tom barrett by nine points. the wind will echo beyond wisconsin. sarah palin told fox news it was a wake up call for president obama. >> i think that the democrats they understand that the president's no show represents the fact that obama's goose is cooked. >> reporter: there is one bright spot for president obama and democrats. wisconsin voters prefer obama over romney 51-44. they have picked democrats during the last six presidential elections. reporting live from washington, d.c. alison burns. 6:16. after conceding the race to governor scott walker supporter added a little sting. you can see a woman slapping

his face when she walked in the crowd. she wanted to slap him for giving up and conceding too soon. he continued greeting people and thanking supporters. 6:16. the city of oakland is setting aside $767,000 to investigate complaints related to the occupy protest. the city is dealing with a backlog of internal affairs complaints. they will use the $750,000 to hire outside help to investigate the complaints. the city has only six months to finish the investigation. army private accused of giving hundreds of thousands of classified documents to wikileaks returns to a military courtroom this morning. bradley manning is seeking dismissile of 10 of the 22 charges against him. the pretrial hearing take place at fort mead in maryland. if convicted of the most serious charges, manning could face life in prison.

6:17. the search for plane crash victims in nigeria it's over now. adana airplane crashed. all 153 people on board were killed. it's still not known how many people on the ground was killed. they will survey the neighborhood. they want to find out who is still missing. authorities say 153 bodies have already been recovered. at least seven americans were among those killed in the crash. mechanical failure forced an air tanker to make an emergency crash landing while fighting a wild fire in nevada. that has been determined by the ntsb. investigators say a landing gear door did not open and the plane was forced to land on its belly. two pilots were killed in that

on sunday. investigators hope to find the cockpit recorder involved in that crash. 6:18. we want to check in with sal castaneda see how traffic is moving. it's starting to get busier. >> it is starting to get busier. we will look at the commutes that are getting a little bit more work. like the bay bridge. here you can see traffic backed up to that parking garage. just about now is when they turn the metering lights on. you can see there is already a crowd developing here. also the morning commute is going to be a little busy on 880 but it's not stop and go. traffic is moving well in both directions here as you pass the coliseum with no major delays. and the morning commute in livermore slow traffic here coming in from tracy, but once you get to dublin it looks good. 101 heading south from burling game still looking good. and for the santa clara valley we are off to a good start.

good morning. interstate 80 westbound you can see traffic getting a little busier in berkeley into emeryville and oakland but not a big problem at all. >> thank you, sal. it's 6:24. mitt romney says authorities are investigating whether his personal e-mail account was hacked. the website gawker reported a hacker broke into romney's hot mail and drop box accounts. the hacker guessed an answer to a security question about romney's favorite pet in order to gain access to the account and change the pass words. the republican presidential candidate used the hot mail address while he was governor of massachusetts. pennsylvania's representative in the miss usa pageant is handing back her crown. she says seen here in a contest interview posted on youtube she

stepped down because the pageant was rigged. but contest officials say she disagreed with their decision to allow trance gender contestants. bay area high school senior is suspended for vandalism lost a court battle to get their suspensions lifted. parents accompanied 12 seniors in two courtrooms yesterday. they got a lawyer to help them plead their case but a judge ruled against them. students from brentwood worried their grades would suffer if they were banned from class in the last week of school for something they believe was an innocent senior prank. >> the statement is not what we wanted but he will hold up the grades of the kids. >> makes me sad. i have gone all this way and looking forward to wearing my cap and gown and now i can't. so it makes me really sad. >> the superintendent says he will allow the students to take finals today and thursday. however, they cannot take part in graduation ceremonies this

saturday. 6:26. californias battle over same sex marriage could now be heading to the u.s. supreme court. yesterday san francisco's ninth circuit court of appeals voted against reconsidering an earlier ruling that decided prop 8 was unconstitutional. that means the majority of the active judges didn't think it was worth revisiting this issue. it cleared the way for supporters and opponents to take the case to the riage has fundamental right. could be very difficult for the supreme court to say the fundamental right to everyone. >> but first the supreme court has to decide if they will hear the case. that is expected to come this fall. more results from last nights election. incrudeing which tax measures are considered. >> a 14-year-old suspect

live. she is in south san francisco getting all the information andy tails on what led up to this deadly shooting. >> reporter: that police suspect is the victim of an officer involved shooting. the woman that identified herself as his aunt told us the suspect/victim is 14 years old. he was at this mcdonalds with friends. we know a police officer tried to make contact with him for reasons we don't know. and then the teenager ran from that mcdonalds through this parking lot all the way to the e. of the arco station lot. that is where the officer who police say feared for his life shot the teen. we were here this morning when officers returned with flashlights presumably looking for more evidence or things they might have missed in their initial investigation. the station clerk on duty this morning described the scene when he started his shift shortly after the shooting. >> the whole gas station nobody

can enter and get out of the station. and a lot of police cars were in the area. >> reporter: is that something you are used to seeing here? >> no, no. first time. >> reporter: now this gas station does have surveillance cameras but they were not focused on the area where the shooting occurred. instead they are focused on the gas pumps and where the shooting curred is on the edge of the arco lot. we also know police found a gun at the scene that they say is the gun that the teenager was carrying. it had not been fired. reporting live in south san francisco noelle walker. >> thank you. 6:32. in election news proposition 29 the cigarette tax initiative is trailing this morning. here's a look at the numbers. 49.2% voted yes on the cigarette sales tax, but a slim majority 50.8 right now have voted no. lorraine blanco joins us live

from -- it's still too close to call. they still need to count the mail in ballots. >> reporter: yes. the nose -- the no's on 29 are ahighway by 63,000 votes. smokers and nonsmokers are surprised by this. bringing the total tax do $1.87. the initiative backed by the american cancer society would have raised more than $700 million for cancer research and health education. >> i think they need to raise it. it's unhealthy, it's sickening our people. it causes lung cancer. it's noty. i don't like cigarettes. >> reporter: the no on 29 campaign mostly bankrolled by

theback industry. the anti29 campaign said it would send research dollars out of state. property 29 spent closer to $18 million temperature we're putting live in san leandro. 6:33. san mateo county voters rejected two tax measures and the third one too close to call. measure t was ahead by only 62 votes. with all the precincts reporting last night. that may change when the mail in ballots are counted. the measure would impose a 2.5% tax on rental car companies. in unincorporated of san francisco. about 54% of voters said no to measure u. now that would have raised the hotel tax from 10- 12%. voters also turned down measure

was found shot to death in the family home. they believe her boyfriend may be responsible for the killing. >> she called me crying two weeks ago. crying because he pushed her. and call her names. bad names. >> i just want to know why. what could she have done to make you so mad? >> emeryville police say they are searching for her boyfriend. they are not releasing any other details because it could jeopardize their investigation. we are now learning there may have been an earlier unreported accusation against a san jose elementary schoolteacher that is accused of molesting five students. police arrested craig chandler back in january after a parent of one of the alleged victims came forward. he is charged with sexually abusing five students at ob whaley elementary school. now prosecutors say a student made a claim about chandler to a school administrator back in october but that administrator

never reported it to police. >> if they have a reasonable suspicion that child abuse has occurred, they are underren obligation to report that. >> state law requires school employees to report any suspected child sex abuse claims to police. the district attorneys office would not identify the school administrator or say if charges would if filed. 6:37. police in napa arrested a woman on suspicion of trying to kidnap a three-year-old child. police say the woman grabbed the child yesterday afternoon at a salvation army store. the woman allegedly hit the child's mother when she tried to take that child back. now police arrived. they did make an arrest on the woman. she is a transient. the child was not hurt. also in just about 90 minutes from now volunteers again will start a new search for sieve era lamar-- sierra lamar. and then again on saturday before they spread out looking

here's a quick look at some of the top stories we are follows for you. a police officer in south san francisco shot and killed someone that he tried to question last night. the officer said the suspect pulled out a gun. relatives of the suspect say he was only 14 years old. so far we don't know yet why the officer tried to question him. wisconsin governor scott walker survived a recall election. walker's opponents launched that recall against him after he successfully ended collective bargaining rights for most public employees. opponents of san jose's measure b they are taking the issue to court after they lost the primary election. voters passed the pension reform measure last night. ktvu will be talking with san jose mayor chuck reid live that is on mornings on 2. it is 6:45. just moments ago we showed

president obama getting on board air force one. he is heading back to the bay area this morning to pick up more money for his reelection campaign. ktvu channel 2 reporter tara moriarty is live at sfo where the president is scheduled to land later this morning. >> reporter: this is really going to be a whirlwind tour. from the time air force one lands at 11:45 until the time the president leaves at 3:15 this afternoon. really he will only be here for 3.5 hours. his helicopter landed at andrews air force base. and then he will board air force one where he is headed here to collect cash for his reelection bid. the last time he was in california he raised $4 million. this time he hopes to rake in $1.5 million. most of that money coming from a luncheon at the julia morgan ballroom. about 300 supporter there is will pay between $500-$50,000 per plate. but it does not come out

she keeps cutting me off, i'm just going to file a lawsuit. >> a large number of lgbt supporters called for a united stand against homophobia and says he does not represent the vast majority of the community. 6:48. sal, is this a pretty good time to get into the commute right now whether you are driving or public transportation? >> i would say so. traffic is doing pretty well. you still have that window we like to talk about before it really gets heavy. the peak of the commute is sometime after 7:00. 7:00 to 8:00 let's just say. you can still get to it. highway 4 getting a little slower coming over the hill. highway 4 is very slow in antioch now. but the good news is we don't have any major crashes along the stretch. just slow traffic which i'm sure you can deal with. you might be used to it by now. let's take a look at the bay bridge toll plaza. that is an 8-10 minute delay. but look at the traffic here.
